Meus caros amigos:
Por enquanto os carros não andam sozinhos e apenas fazem aquilo que se lhes manda fazer; Um carro qualquer por muito que tenha para poder oferecer ainda só, e apenas, faz o que o elo mais fraco (a peça entre o volante e o assento ) lhe mandar fazer.
Se essa peça tem ou não kit de unhas para o utilizar e dele tirar proveito é uma conversa totalmente diferente.
Os carros não são assassinos! Os aspirantes a pilotos que julgam que lá por terem dinheiro para os adquirir já sabem da poda e por isso podem sair por aí a acelerar à parva que o carro lhes perdoa, esses é que estão enganados quando confundem a via pública com uma pista de corridas, e condução com pilotagem!
Se quereis meter a "culpa" nalgum sítio metei-a no inconsciente que se julga rei do mundo; agora culpar uma peça mecânica que não tendo vontade própria pode por artes de magia fazer ou deixar de fazer seja aquilo que for???
Lamento ter opinião diferente da vossa mas esta é a minha maneira de ver as coisas; sabem que a idade não nos torna mais sábios; torna-nos é mais lentos, daí termos mais tempo para pensar!
Ainda há bem pouco tempo eu escrevi por aqui algures: O cérebro é uma coisa maravilhosa; toda a gente devia ter um!

Uma informação que pode ser PERTINENTE e, apesar de estar em Inglês, deve ser bem lida!
I refer to your questions, sent through the Europe Direct Contact Centre (EDCC) and
registered under the reference CHAP(2015)2985. In your inquiry, you ask whether the
Portuguese registration tax for second-hand vehicles should be suspended as the
Commission has referred Portugal to the EU Court of Justice ("the Court") in case C-
200/151 arguing that the Portuguese registration tax is incompatible with EU law. This as
the calculation of the taxable value of second-hand vehicles introduced into Portugal from
another Member State does not take into account the real value of the vehicle. Furthermore,
you ask what means of redress are available to you as you have previously paid the
registration tax.
Firstly, regarding the question whether the tax should be suspended until the Court has ruled
if it is compatible with EU law or not, it is important to note that the role of the
Commission, as the 'guardian of the Treaties', consists in ensuring that the national
legislation (in this case vehicle taxation) complies with EU Law. To this effect, the
Commission may initiate an infringement procedure against a Member State in order to
ensure such compliance. However, the Commission may not interpret EU law as this is
something only the Court can do.
Actions before the Court does not, as a general rule, have suspensory effects according to
Article 278 of the Treaty on the Functioning of the European Union ("TFEU"), but the
Court may order the application of a contested act to be suspended, or issue any interim
measures should it be necessary according to Article 279 TFEU. However, the Court may
order interim measures only if it is established that such an order is justified in fact and in
law, and that it is urgent in order to avoid serious and irreparable harm to the applicant's
interests. This is not the case in this matter, especially since (as further explained below)
there is an obligation on the Member State to reimburse individuals who have paid a tax
incompatible with EU law.
This means that as long as the Court has not ruled on the Portuguese registration tax or
decided on any interim measures, the tax is not contrary to EU law and continues to apply
until such a ruling has been issued. The Member State may of course voluntarily decide to
suspend the tax, but is not obliged to do so according to EU law.
Secondly, regarding the means of redress available to you, the Court has consistently held
that individuals are entitled to obtain repayment of charges levied in a Member State in
breach of EU law. That right is the consequence and the complement of the rights conferred
on individuals by EU law as interpreted by the Court. The Member State in question is
therefore required, in principle, to repay charges levied in breach of EU law.3 The only
exception to that obligation is if it is established by the national authorities that the charge
has been borne in its entirety by someone other than the taxable person, and that
reimbursement of the charge would then constitute unjust enrichment.4
It is up to the domestic legal system of each Member State to ensure that the Member State
is obliged to refund national taxes which have been wrongly levied.5 Member States may
establish procedural conditions according to their national law, but those conditions must
not be framed in such a way as to make it, in practice, impossible or excessively difficult to
obtain reparation (principle of effectiveness) and they must not be less favourable than those
relating to similar domestic claims (principle of equivalence).
The Court's judgment in case C-200/15 is expected in early 2017, based on the most recent
statistics from the Court.6

Lamento mas não confio nas instâncias nacionais ou europeias para corrigir a extorção que é a tibutação de veículos clássicos importados sobretudo depois de Julho de 2007 . Nos finais desse ano importei o meu 924 Carrera GT que , apesar de fazer cerca de 1000kms /ano pagou em 2016 quase 500 € de IUC que de único não tem nada . Se esse IUC não é contra a livre circulação de bens na UE não sei o que será.
